الملخص

يهدف البحث الى بيان اجراءات انفكاك الموظف المحال الى التقاعد، وبيان ماهي حقوق الموظف المحال الى التقاعد المالية وكذلك في حال وجود التزامات مالية تتطلب تسديدها من قبل الموظف الى الادارة في حال هناك التزامات مالية بذمة الموظف المحال الى التقاعد. وتكمن أهمية البحث ان الكتابات المتعلقة بهذا الموضوع على الرغم من اهميتها الكبيرة غير كافية، والنصوص الموجود في القوانين فيما يتعلق بالحقوق لشريحة كبيرة من المستفيدين، الا ان تلك الكتابات لم توفي الحاجة الفعلية والمطلوبة لضمان تلك الحقوق وذلك لما قدمته تلك الشريحة المهمة من خدمة وافنوا شبابهم في اعمالهم الوظيفية. انقسم البحث الى مبحثين تناول الاول الاحكام العامة لانفكاك الموظف العام المحال الى التقاعد، وتطرق الثاني للاثار القانونية والمالية المترتبة على انفكاك الموظف العام.
