The fault in the default management responsibility
Abstract
The theory of management responsibility, like that of most administrative theories, was nothing but one of the fruits of the French Judicial Councils judiciary. By its structural jurisdiction, the council was able to override the rules of the private law that were regulating this issue, and by the provisions of Articles 1392 and the following French civil law, independent administrative responsibility was clearly affirmed through the famous case, the Blanco case, and after that the rulings of this responsibility were followed through the rulings of the administrative courts.
