The Legal Nature of the Engagement A Comparative Study
Abstract
Marriage is one of the most important contracts, and it is considered a great covenant and holy link. Therefore, it has taken full care of it in its various stages, from the moment it is a thought in the mind, through the stage of the betrothal to its actual existence, as well as the state of its abolition and termination. He also distinguished him from other contracts by making him two prerequisites, and these are the two: the choice and the betrothal. At the stage of choice, Islam allowed the person to look at his engagement if he was looking at it as a suitor. The second is the field of our research, which is the engagement, which derives its importance from being a pre-marriage stage and its preamble. In the engagement, it is possible to avoid the consequences of rushing into marriage. Thus, the lives of the couple are more stable. They create the conditions to inform the parties to the betrothal about the possible discrepancy in nature between the two parties to engage in the future marriage.
