The complaint about the crime of marital adultery in Iraqi legislation is a comparative study of Islamic jurisprudence

Abstract

The motive of imitating the legislation of the situation has had a great effect on taking our Iraqi legislator to the complaint of adultery, as a procedural restriction that leads the public prosecution to move criminal responsibility against the adulterous husband and his partner. Under this condition, the victim's husband has the right to dispose of the complaint in terms of lifting or waiving it Or refraining from progressing to the judiciary if he wants to conceal the news of crime and avoid the damaging scandal
