Formalism in Electronic Contracts
Abstract
The formality is a method of legal maintenance known to the oldest legal systems and is still present in modern systems, but they have developed its concept.Formality emerged in primitive systems as a result of the elders' desire to embody the morale and to give it awareness or visionary entity, symbolizing it. This was formal (symbolic) involving special movements that responded to human instincts.The Roman law of the ancient era was fertile ground for this formality. This law was not known of legal acts except what had a legal form since the lack of form was alienated from the nature of the ancient Romans.
