Some types of compensation in Islamic Sharia for the deceased and its impact on the family of the slain ((comparative study))
Abstract
The importance of this research comes from being a serious attempt to study the effect of reparation in warding off what the felony causes of disturbance as tranquilization for the victims family and faring away their hurt from the criminal from here, the research tackles the effect of reparation, wergild, and the felony to receipt the concept of partiality and its aim . For, this paper deals with each of them with definition clarification, and analysis according to the Islamic Jurisprudence Islamic Sharia Holy Quraan and Prophetic Sunna, in addition to the views of Juris prudists and scientists of religion in this matter. This study also clarifies the subject from the points of view of the Juris prudistic doctrines: Al-haneefia, Al-malikia, Al-Shafia, and Al-hambalia, Finally it presents the results that research have reached.Then , it becomes necessary to present this partiality which is considered one of the rights of religion , that reparations , to our recent society because of its importance in the present state of the society and the its change which leads to the appearance of other views that accompany the appearance of new type of crimes that this society suffers.
