الملخص

قد یرى المشرع ان بعض الاشخاص یشترکون فی صفات معینة تجعلهم بحاجة الى حمایة خاصة ومن هذه الفئات الاطفال الذین یعانون  قصوراً بالقیام بمهام حیاتهم بصورة طبیعیة، لذلک لا بد من توفیر حمایة دستوریة وقانونیة  لهم تتناسب مع حالتهم، اذ ان ما یعطى لهم من حمایة للحقوق لیس لمصلحتهم الشخصیة البحتة وانما لمصلحة المجتمع ایضاً، لان ای اعتداء على الاطفال یمثل اعتداء على المجتمع بأسرة، لانهم اساس المجتمع ومما یلاحظ انه  بالرغم مما تناولته الدساتیر والقوانین  من نصوص لحمایة هذه الفئة الا ان الحمایة کانت قاصرة اذ  بقیت هذه الفئة تعانی من الکثیر من الاهمال اما لقلة النصوص القانونیة  التی تضمنت النص على هذه الحقوق او بالنسبة لکیفیة تطبیق هذه النصوص اذ ان الفائدة تکمن فی التطبیق السلیم لنصوص القوانین ولیس فقط بوجود هذه القوانین فهنالک العدید من القوانین التی بقیت حبراً على ورق ولم تنفذ اطلاقاً.
