آثار تخصص القاضی المدنی فی حسم الدعوى المدنیة (دراسة تحلیلیة مقارنة )

الملخص

یعد تخصص القاضی المدنی من الامور المهمة والمطلوبة للعمل القضائی لما تعانیه المحاکم الیوم من تراکم فی الدعاوى القضائیة وبطء التقاضی, لذا یعرف التخصص من خلال بحثنا بانه تقیید القاضی النظر فی منازعات فرع واحد من فروع القانون بتشریعاته الخاصة, وتأهیل القاضی تأهیلا علمیا کاملا لتولی منصب القضاء, اذ یبدو لهذا التخصص اهمیة کبیرة من خلال اکتساب القاضی الخبرة فی مجال تخصصه وتفعیلا لدوره الایجابی, إذ یجد التخصص اساسه التشریعی فی کثیر من القوانین ذات العلاقة, الا ان اغلب النصوص التی عالجته ولدت میتة اذ لم ترا النور من حیث التطبیق, وهذه الفکرة لا تخل من العیوب الا انه هناک الکثیر من الممیزات فضلاً عن انه یمکن تلافی عیوبها وللتخصص آثار سواء فی الدعوى المدنیة من حیث سرعة حسمها منع تراکم الدعاوى والحیلولة دون بطء لتقاضی او من حیث الاثار التی یترکها التخصص فی القاضی نفسه من حیث تحقیق هیبته وسلامة الاجتهاد والوصول الى القناعة القضائیة, واخیرا توصلنا فی ختام هذا البحث الى مجموعة من النتائج والتوصیات التی نامل ان تؤخذ بعین الاعتبار.
