Contraindications of commitment to restitution in kind in the judicial implementation A Comparative Study
Abstract
A judicial judgment represents the end of a prosecution, because this provision is to decide which right the merits of the case and determine the owner and committed. But it does not stop at this point, but must be convergence of these provisions implemented on the ground. Considering that implementation is the final stage of the protection of rights and Aqtdhaeha, and naturally it is issued judgment in favor of the initiative directly to get this right by resorting to the Directorate of implementation to require the right, especially since the legislature has authorized the implementation of the provisions once issued and even during the period of appeal legal .
