الملخص
تعد نظریة الصعوبات المادیة غیر المتوقعة من النظریات المهمة فی القانون الإداری التی اقرها مجلس الدولة الفرنسی حیث تنهض أثناء تنفیذ العقد مشاکل وصعوبات مادیة استثنائیة غیر متوقعة ولا یشترط أن تؤدی إلى جعل التنفیذ مستحیلاً وإنما مرهقاً للمتعاقد ، ومکلفاً له بصورة لم یتوقعها عن التعاقد بحیث یترتب علیها حصول المتعاقد على تعویض کامل عن جمیع الأضرار التی تحملها نتیجة هذه الصعوبات
