Abstract

This study examines how varying ideas, principles, and values within human societies influence lawmakers as they craft legislation, focusing on laws governing the status of foreigners residing within a country. Specifically, it considers Iraqs Foreigners Residence Law No. (76) of 2017, which, like similar laws in other jurisdictions, regulates foreign residency while recognizing the right to seek refuge outside ones country of origin. This right, however, is subject to conditions set by the host countrys national laws, with penalties applicable for violations. The study defines the concept of foreigner, reviews the entry conditions outlined in Iraq's residency law, and analyzes the laws strengths and weaknesses. Additionally, it addresses the material and psychological elements that characterize violations of entry requirements. The study concludes with findings and recommendations for improvement.
