تنفیذ القرار الإداری قضائیاً

الملخص
یعد القرار الإداری من أهم الامتیازات التی تتمتع بها الإدارة إذ تمتلک الإدارة أن تصدر قرارات بإرادتها المنفردة وتلزم بها الغیر بینما لا یمتلک الفرد فی نطاق القانون الخاص أن یفرض التزامات على عاتق غیره من الأفراد بإرادته المنفردة وتکون له القوة الملزمة، کما ان السبیل لترتیب الاثار القانونیة بالنسبة للفرد تکمن فی فرض التزامات على عاتقه والمتمثلة بالحصول على موافقته ورضاه ای فی صورة عقد. کما إن القرار یحتاج الى تنفیذ، والذی یعد الأهم إذ انه لا یحدث الأثر والنتیجة القانونیة المتوخاة منه إلا بتنفیذه والواقع ان هناک فارق کبیر بین الأثر القانونی للقرار وبین التنفیذ المادی للقرار، اللازم فی معظم الحالات لتحقیق التناسق بین الحقیقیة المادیة وبین ذلک النظام القانونی الذی عدله القرار. والأصل أن تلجأ الإدارة فی تنفیذ قراراتها إلى القضاء إلا انه واستثناءً تُعطى الإدارة احیاناً الحق للتنفیذ المباشر وهو لجوؤها لتنفیذ قراراتها بالقوة الجبریة مع إعفائها من اللجوء إلى القضاء. لذلک سوف ابحث فی موضوع التنفیذ القضائی للقرار الإداری من حیث أن القرار الإداری یمثل التجسید القانونی لمظهر السلطة فی نشاط الإدارة، ویجب تنفیذه بالوسائل والطرائق التی رسمها القانون وذلک عن طریق التنفیذ الاختیاری للقرارات الإداریة والتنفیذ الجبری المباشر والتنفیذ عن طریق القضاء.
