المسؤولية المدنية عن الخطأ في الشهادة الطبية

الملخص
تعد المسؤولية المدنية للشهادة الطبية ذات اهمية كبيرة كونها ترتب حقوقا لصالح طالب الشهادة الطبية والتزاما يقع على عاتق الطبيب عند تحريره لشهادة طبية مخالفة للحقيقة وعلى الرغم من وجود الشهادة الطبية في ثنايا القوانين الطبية العراقية الا انه لم يتناولها بالتنظيم في قانون خاص بها وتحديد المسؤولية المدنية التي تترتب على صدورها بشكل مخالف للحقيقة وذلك لان المسؤولية المدنية للشهادة الطبية الخاطئة تختلف اذا صدرت الشهادة عن طبيب عام او صدرت عن طبيب خاص وذلك لان الشهادة الطبية الخاطئة اذا صدرت عن طبيب عام اي طبيب يعمل بالقطاع العام تعتبر مسؤولية الطبيب مسؤولية تقصيرية وذلك لان الطبيب يعتبر موظفا عام اما اذا صدرت عن طبيب يعمل بالقطاع الخاص اي بالمستشفيات الاهلية او في عيادته الخاصة تعتبر مسؤوليته مسؤولية عقدية وذلك على اعتبار وجود عقد بينه وبين الطبيب الخاص وقد تقع المسؤولية على المرفق الصحي العمومي اي مسؤولية المتبوع عن اعمال تابعه اذا كان خطا الطبيب العام يرجع الى المرفق الصحي وينسب اليه.
