الملخص

تعد ملكية الأجزاء المشتركة في العمارات والطوابق والشقق في القانون الإنكليزي إحدى أنواع الملكية العقارية التي ترد على العقارات المبنية عمودياً ولا سيما العمارات, التي تقسم الى مجموعات من الوحدات كالشقق السكنية والمكاتب ومراكز التسوق. ويعد التنظيم القانوني لهذا النوع من أنواع الملكية الشائعة في القانون الانكليزي حديث نسبياً, أدخله المشرع الانكليزي عن طريق تشريع إصلاح نظام ملكية الأجزاء المشتركة في الطوابق والشقق والإجارة الطويلة لها لعام 2002. ويدار هذا النوع من أنواع الملكية عن طريق اتحاد  أو جمعية إدارة ملكية الأجزاء المشتركة في العمارات والطوابق والشقق, التي تتولى إصدار بيان يعرف ببيان جمعية إدارة ملكية الأجزاء المشتركة. أما القانون العراقي فقد نظم ملكية الأجزاء المشتركة في العمارات والطوابق والشقق في قانونين: الأول هو قانون تنظيم ملكية الطوابق والشقق في العمارات العراقي رقم 61 لسنة 2000 , والثاني هو قانون التسجيل العقاري رقم (43) لسنة 1971 الذي تضمن نظام ملكية الطوابق والشقق في المواد (290-297) منه. في الوقت الذي تضمن فيه القانون المدني العراقي رقم (40) لسنة 1951 نظام العلو والسفل في المواد (1082-1086) منه.
