العشوائیات وملاءمتها لسکن المطلقة

الملخص

تعود مشکلة ظهور السکن العشوائی إلى بدایات القرن العشرین فی الوقت الذی بدأ فیه التوسع العمرانی السریع للمدن مع تمرکز الخدمات والمصالح الحکومیة فی المدن الرئیسة وظهور العدید من الصناعات الحدیثة مما أدى بدوره إلى زیادة الهجرة الداخلیة للأفراد والنزوح من الریف إلى المدن سعیاً وراء الحصول على فرص العمل، حیث ان العراق یعانی من السکن العشوائی, وقد انتشرت العشوائیات فی مختلف مدنه مهما کان مستوى التطور والتقدم فی هذه المدینة أو تلک. حیث اصبحت هذه ظاهرة تنتشر فی اغلب المدن العراقیة لتشکل أحزمة تحیط بالمناطق الحضریة مما تسبب فی تداعیات خطیرة جداً , بعضها یمکن معالجته , لکن الاغلب من المشاکل یصعب معالجتها لتأثیرها فی البنیة الحضاریة للمدن, بحیث أصبحت العشوائیات سمة تتسم بها المدن العراقیة فی مرحلة التحول العمرانی، مما أدى الى تشوه المدن العراقیة التی أثرت بدورها فی التنمیة الحضریة المستدامة بصورة مباشرة وغیر المباشرة من خلال تعارض العشوائیات مع أهم أرکان التنمیة المستدامة وهو عدم توریث المشاکل للأجیال القادمة. وقد أراد الشارع الحکیم التخفیف عن الزوجة المطلقـة حدة الفراق بینها وبین زوجها ومنحها مـن الحقـوق التـی یمکن أن تخفف عنها مصیبتها، ویُعد السکن أحد تلک الحقوق التی تحفظ للزوجة به کرامتها وعزتها، لذلک اقتضت حکمة الله (سبحانه وتعـالى) الحکم بأحقیتها فی السکن بمقتضى آیات قرآنیة کریمة، وأحادیث نبویة شریفة رویت عن الرسول (صلى الله علیه وسلم) بشأن حق الزوجة المطلقة فی السکن. وعمل المشرع العراقی فیما بعد لاعتبارات من العدالة التی تقضی بمنح الزوجة المطلقة التی لیس لها مسکن یؤویها بعد طلاقها حق السکن فی الدار أو شقة الزوجیة، فضلاً عن دفع الضرر الذی یمکن أن یقع علیها، ولکن ممارسة الزوجة المطلقة حقها فی السکن یشترط فیه بأن تفصح عن رغبتها أمام المحکمة التی تنظر دعوى طلاقها، وتصدر محکمة الموضوع فی ختام الدعوى قرارا ً بإبقائها فی الدار أو الشقة الزوجیة من دون الزوج، ولکن یقتضی ذلک حتماً عدم إلحاق الزوجة المطلقة أی ضرر بالغیر سواء أکانوا أشخاصاً عامة أم خاصة، لذلک عمد المشرع العراقی الى تشریع قانون حق الزوجة المطلقة فی السکنى بموجب القانون رقم 77 لسنة 1983 المعدل بالقانون رقم 2 لسنة 1994ضمن شروط معینة.
