الملخص

یعد الضبط الاداری من اهم الوظائف فی الدولة والتی تستهدف حمایة النظام العام فی المجتمع والمحافظة علیه ومنع انتهاکه والاخلال به، اذ تشمل هذه الحمایة عناصر النظام العام التقلیدیة (الامن العام والصحة العامة والسکینة العامة والآداب العامة) وکذلک عناصره الحدیثة (الحفاظ على البیئة وتنسیق جمالیة المدن) والتی تسعى الادارة فی الحفاظ علیها عن طریق فرض اجراءات وضوابط من خلال الترخیص المسبق فی البناء وعدم التجاوز على اراضی الدولة ،وتخطط لاستخدامات الارض وضمن واجبها فی حمایة النظام العام وبدأت الدولة ومنذ الثورة الصناعیة تضع تصامیم اساسیة ومخططات للمدن. تعد تراخیص البناء احد الادوات القانونیة للرقابة على انشاء المبانی إذ بواسطتها تبسط السلطات الاداریة المختصة رقابتها على البناء. وتکمن اهمیة البحث انه وثیق الصلة بحیاة الافراد والمجتمع وسلامتهما ,ویعد تدخل الادارة هنا لإیجاد نوع من التوازن بین حریة الافراد فی البناء واحترام قواعد التخطیط العمرانی من جهة وسلطة الادارة الضبطیة والتی تتمثل بجملة من القیود المفروضة على طالب الترخیص من خلال فرض قواعد والضوابط الفنیة الخاصة بالبناء و وشروط السلامة وقواعد المحافظة على النظام العام ضماناً للتطور العمرانی وتجنباً للعشوائیات التی ظهرت بشکل متسارع بصورة التجاوز على اراضی الدولة فی عموم العراق بعد 2003. وکما یستهدف البحث القاء الضوء على القوانین ذات الصلة  بالبناء منها نظام الطرق والابنیة فی العراق رقم 44لسنة 1935 المعدل قانون البلدیات رقم 13 لسنة 2001. وان مشکلة البحث تکمن فی عدم وجود نظام قانونی متکامل لتراخیص البناء فی العراق، فضلاً عن ازدیاد حالة العشوائیات بسبب ضعف رقابة الاجهزة الاداریة المختصة. ولأجل هذا قسمنا البحث على مبحثین نتناول فی المبحث الاول ماهیة الضبط الاداری فی مجال البناء والمبحث الثانی الرقابة الاداریة فی مجال استخدامات الارض الحضریة وفی الخاتمة البحث تناولنا اهم الاستنتاجات والتوصیات.
