الملخص

ان المسکن الذی هیئه الزوج على اراضی الدولة دون اذنها، لإسکان زوجته، مختلف فی مدى مشروعیته من الناحیة الفقهیة والقانونیة والقضائیة، فمن الناحیة الفقهیة هنالک ثلاثة اراء، الاول منع البناء على اراضی الدولة دون اذن مسبق، والثانی اجاز ذلک دون اذن، والثالث اجاز للضرورة، اما من الناحیة القانونیة فالمشرع العراقی من حیث الاصل منع التجاوز على اراضی والزم الجهات المختصة بازلة المبانی، ولکنه فی الوقت نفسه قام بتملیک بعض المتجاوزین لهذه الاراضی ببدل معین، کما انه عوض البعض الاخر مبالغ مالیة مقابل ازالة التجاوزات، اما من الناحیة القضائیة، فقد اعتبر القضاء العراقی المسکن العشوائی مسکنا شرعیا لسکنى الزوجة کواقع حال، یترتب علیه ما یترتب على المسکن الشرعی النظامی من اثار تتعلق بالحقوق الزوجیة.
