التزام السلطات الاتحادیة فی مجال تأمین السکن الملائم وفق دستور جمهوریة العراق لسنة 2005 -دراسة مقارنة-

الملخص

لاشک ان الحقوق والحریات العامة تحتل مکانة اجتماعیه مهمة  فی الحیاة البشریة، باعتبارها اسمى القیم الانسانیة بل واسماها على الاطلاق، فهی ترتبط بهم وجودا او عدماً، فأضحت البشریة فی اطوارها المختلفة على الایمان والتمسک بها، کما انها من مقومات الانسان نفسه ولا یمکن ان تکون ترفا، اذ حرص علیها فی سبیل صیانتها، فجمیع الثورات والانتفاضات التی قامت بها الشعوب ضد تعسف السلطات الحاکمة، کان الهدف منها انتزاع هذه الحقوق والحریات، ومن ثم فإنه فی النتیجة تم تسطیرها فی نصوص دستوریة وقانونیة تکفل ممارستها وحمایتها . ویعد حق الافراد بالحصول على السکن الامن، أحد تلک الحقوق والحریات الخاصة بهم، حیث تمکنهم وعوائلهم العیش بأمان وبکرامة بعیدا عن التشرد والسکن فی العشوائیات التی تفتقر لأبسط مقومات الحیاة، أن الأهمیة التی یحتلها موضوع البحث وهو حق السکن الملائم، یأتی فی محورین اساسیین، الاول هو ان الاعتراف الدستوری والقانونی لا یکفی الا بوجود ضمانات کافیة من شانها ان یطمن الیها الافراد بالشکل الذی یحفظ کرامتهم، والثانی ان اتباع استراتیجیة متکاملة من قبل المؤسسات الدستوریة خاصة بعد ازدیاد عدد السکان وما یترتب علیه من ازدیاد الحاجة الى انشاء وحدات سکنیة نموذجیة وهنا یتوجب ان تتظافر الجهود فی هذا الخصوص تتظافر  للحد من العشوائیات.
