آلیة الحمایة المدنیة للأصناف النباتیة الجدیدة –دراسة مقارنة-

الملخص

مما لاشک فیه أن أهمیة الأصناف النباتیة ازدادت بشکل کبیر فی الآونة الأخیرة فی مجال التقنیة الحیویة بالنسبة للإنتاج الزراعی، ودخلت الى مجال التطبیق،  وأدى هذا الى استنباط اصناف نباتیة جدیدة تتمیز بخصائص فریدة تکون بحاجة الى حمایة خاصة.        حمایة الأصناف النباتیة الجدیدة عن طریق قواعد الملکیة الفکریة قد تکون غیر کافیة، ولذلک تبنّت الکثیر من الدول النامیة ومنها العراق المعاییر الدولیة لحمایة الأصناف النباتیة فی سبیل ملائمة تشریعاتها مع المعاییر الدولیة ذات الصلة، إلاّ أنها قد تجد نفسها فی مشکلة کبیرة  جراء هذا الالتزام الدولی.       ومن هنا یتوجب وضع آلیات قانونیة مناسبة لحمایة الأصناف النباتیة الجدیدة، وأن یفرض على مستنبط الصنف النباتی الجدید تقدیم المعلومات الکافیة على جمهور المستهلکین، وذلک للحد من المخاطر الصحیة المتوقعة.
