الملخص

ان الدستور هو القاعدة التی ترتکز علیها مؤسسات الدولة، وهو الذی یحدد اوجه السلوک التی لا یجوز للقائمین علیه ان ینحرفوا عنها، وطبقا لذلک یکون للمحکومین ضمان ان الدستور قائم على المشروعیة الدیمقراطیة والتی تعتبر نصوص الدستور قواعد دستوریة واجبة التطبیق، الا ان ذلک لا یمنع من تعدیل بعض الدستور بما ینسجم مع تطور الواقع السیاسی والاجتماعی والاقتصادی فضلاً عن الحفاظ على وحدة واستمراریة الدولة طبقاً للتوجهات الجدیدة.
