حجة وقفية نموذجية دراسة حالة

الملخص
تعدّ الحجة الوقفية دستور الوقف بموجبها تنتظم احكام الوقف الشرعية والقانونية بما يريد الواقف في ايراد شروطه التي تعدّ شروطاً معتبرة واجبة التنفيذ لان شرط الواقف كنص الشارع، ولدى اطلاع على مجموعة الحجج الشرعية الوقفية، لاحظنا وجود ارتباك في بعضها من حيث الصياغة والشروط والاحكام الاخرى. لذا بادرنا الى دراسة حالة لصياغة حجة وقفية نموذجية مبيناً فيها مشروعية الوقف، واركانه وشروطه، ونفاذه ولزومه، والآثار المترتبة على الوقف، وشروط الواقف في نوعية المصرف على الموقوف عليه فضلاً عن شروط أحكام التولية على الوقف.
