استخدام تقنية GPS في تتبع الموقع الجغرافي للمتهم
الملخص
تعد تقنية ( GPS)، وهي نظام تحديد المواقع العالمي، احدى الوسائل التكنولوجية الحديثة التي تستعين بها أجهزة العدالة الجنائية في سبيل التحري عن الجرائم وضبط المجرمين، ولمواجهة الاساليب التقنية التي يستخدمها المجرمون في جرائمهم . يثير استخدام هذه التقنية مسألة مشروعية استخدامها ومدى قبولية الادلة المستمدة منها أمام القضاء الجنائي، وتوصلنا من خلال دراستنا الى امكانية اللجوء الى هذه التقنية وفق ضوابط قانونية وفنية تضفي المشروعية عليها وتجعلها مقبولة وذو حجية نسبية متروكة لاقتناع القاضي لكونها من الادلة العلمية، وقد اوصينا بضرورة الاخذ بهذه التقنية عند قيام اعضاء الضبط القضائي بواجباتهم في التحري عن الجرائم من خلال نصوص واحكام تفصيلية في قانون اصول المحاكمات الجزائية.
