Abstract

This study revolves around the idea that, within the scope of his job, the public employee differs in status, and the exercise of his rights and freedoms is somewhat affected due to the restrictions imposed by functional laws. Among these restrictions and duties is the duty of job reservation, which requires the employee to exercise a degree of restraint in expressing opinions or in the manner of communication with superiors, colleagues, or the publicboth within and outside the workplace. Therefore, it is necessary to clarify the definition of this duty, its legal origin and basis, and the significant role of the administrative judiciary in formulating and deriving this duty through its rulings, as well as its role in reviewing administrative decisions.
