السلطة التشریعیة بین الغرفة الواحدة والغرفتین فی الأنظمة الدستوریة

الملخص
ان دستور العراق لسنة 2005 اختار أن یکون برلمانه مکوناً من غرفتین (مجلس نواب ومجلس اتحاد) وکان مشرعنا الدستوری موفقا فی ذلک کونه انسب الأنظمة المختارة للدول التی تتمیز بتعقید عرقی، وان نظام الغرفتین هو الطریقة المثلى لتنظیم البرلمان فی الدول ذات الاتحاد المرکزی، الا ان دستورنا جاء ناقصا ومعیبا بالنسبة لتنظیم البرلمان مما حدا به أن یکون غیر معلن، فالغلبة واضحة لغرفته الأولى فضلا عن ما شابه من أخطاء اعترت عملیة تشکیل غرفته الثانیة،فعلى الرغم من نصه على تشکیل مجلس تشریعی یسمى بمجلس الاتحاد لیکون جزءا من السلطة التشریعیة الاتحادیة الى جانب مجلس النواب، ویمثل الأقالیم والمحافظات غیر المنظمة فی إقلیم، الا أنه جعل من الغرفة الثانیة (مجلس الاتحاد) والذی یفترض أن یحقق التوازن مجلسا تابعا لمجلس النواب، ویمثل الأقالیم والمحافظات غیر المنظمة فی إقلیم.
