أثر الظروف الطارئة فی تنفیذ العقد الإداری

الملخص
عندما تختل اقتصادیات العقد اختلالاً جسیماً لظروف استثنائیة لم یکن فی الوسع توقعها عند إبرام العقد، وینتج عن ذلک جعل التنفیذ أکثر إرهاقاً للمتعاقد بما یترتب علیها من خسائر تجاوز فی حدتها الخسارة العادیة المألوفة فی التعامل، فإن للمتعاقد الحق فی طلب مساعدة جهة الإدارة للتغلب على هذه الظروف کی تشارکه فی تحمل جزء من الخسارة التی لحقت به وهذا هو جوهر نظریة الظروف الطارئة. التی نظمتها المادة 146 / 2 من القانون المدنی العراقی رقم ( 40 ) لسنة 1951 وتتلخص آثار هذه النظریة فی التزام المتعاقد المضار بالاستمرار فی تنفیذ العقد من ناحیة والتزام الإدارة المتعاقدة بتعویض المضار من ناحیة أخرى
