الملخص

يفتح التقدم العلمي والتكنولوجي في الوقت الحاضر افاقا كبيرة امام تقدم البشرية الا انه يحمل في الوقت نفسه مخاطر جسيمة تهدد حقوق وامن الافراد والجماعات، ولعل النشر عبر مواقع التواصل الاجتماعي يعد من اهم الوسائل التي تنطوي على تلك المخاطر اذا ما أُسيء استعماله وهنا تبرز احكام المسؤولية باعتبارها السلاح الذي يهتدي به رجل القانون لمواجهة أي خطر يداهم امن الفرد وحقوقه، ولكن قواعد المسؤولية رغم مواكبتها للتغيرات التي تطرأ على ارض الواقع كشفت عن قصورها النسبي في مواجهة تلك التحديات الناتجة عن المعاملات الالكترونية لذا بدت الحاجة الى توفير الحماية الوقائية للفرد من تلك المخاطر للحيلولة دون وقوع الضرر عن طريق إيجاد تنظيم قانوني متكامل للنشر عبر مواقع التواصل الاجتماعي وتحديد مسؤولية مستخدمي النشر عبرها.
