الملخص

يعد حق الملكية في القانون الإنكليزي من أفضل الحقوق العينية التي يتمتع بها الشخص وأعلاها مرتبةً، ويمنح صاحبه حقاً غير محدود في التصرف في الشيء المملوك واستعماله واستغلاله والسيطرة المادية الخالصة عليه. ويشمل هذا الحق حزمة من الحقوق التي يمكن لصاحبها التمتع بها. ويعد حق الملكية في القانون الانكليزي حقاً مطلقاً من حيث الأصل, يمكن المالك من التمتع بملكه, من دون أن تفرض عليه أية عوائق أو قيود, إلا أنه يجوز أن تفرض عليه بعض التكاليف العينية التي تقيد منه. كما تفرض عليه حقوق الأرجحية, ولا سيما على العقارات المسجلة, وينبغي على مالك العقار المسجل الالتزام بها تلقائياً, على الرغم من عدم تسجيلها في هيئة التسجيل العقاري. وبالمقابل فقد نظم القانون المدني العراقي رقم (40) لسنة 1951 حق الملكية وعده حقاً عينياً أصلياً تتفرع عنه جميع الحقوق العينية الأصلية الأخرى. وهو حق دائم في وجوده ومانع استئثاري يقتصر على المالك نفسه دون غيره, وجامع يستأثر بمقتضاه المالك على جميع السلطات
