الملخص

نسعى فی بحثنا الموسوم (المسؤولیة الجنائیة عن إیقاف أجهزة الإنعاش الصناعی) إلى بیان ماهیة أجهزة الإنعاش الصناعی وأنواعها وبیان أهمیة هذا النوع من العلاجات، والمسؤولیة الجنائیة عن إیقاف هذه الأجهزة ذلک أن مسؤولیة الطبیب أو الفریق الطبی المسؤول تکون واردة فی کل حالة من الحالات التی یأتی بها الطبیب عملاً من الأعمال التی تخالف الأصول الفنیة المعمول بها فی نطاق مهنته، فإیقاف أجهزة الانعاش الصناعی یمس حقاً من حقوق الإنسان وکرامته التی نصت علیها الشریعة الإسلامیة والقوانین الوضعیة، والتی أوجبت على الطبیب أو الفریق الطبی أن یبذل ما فی وسعه لإنعاش المریض باستخدام هذه الأجهزة وأن یستمر فی ذلک حتى یسترد حیاته، ذلک أن استخدام هذه الأجهزة قد أدى إلى انقاذ الکثیر من الحالات، حیث تقوم هذه الأجهزة بتعویض الفشل الذی یحدث فی بعض الأعضاء الحیویة فی جسم الإنسان أو تساعد على إعادة نشاط تلک الأعضاء، أو تعویض ما نقص من مواد أساسیة ضروریة لحیاة الجسد، إلى غیر ذلک من الوظائف الحیویة التی تؤدیها تلک العلاجات وما یستعمل معها من أجهزة والتی تتطلب من الأطباء أو الفریق الطبی المعالج ملاحظة طبیة شاملة ودقیقة فی وحدات العنایة المرکزة وفی ضوء ذلک قسمنا البحث إلى ثلاثة مباحث رئیسیة، یتعلق الأول بماهیة أجهزة الإنعاش الصناعی ویتضمن المبحث الثانی تحدید معیار الوفاة، ویتناول المبحث الثالث أحکام المسؤولیة الجنائیة عن إیقاف أجهزة الإنعاش.
