أثر الإجراءات الانضباطیة على ترقیة وترفیع الموظف العام -دراسة مقارنة-

الملخص
یُعد نظام الترقیة والترفیع من أهم الأنظمة التی تسهم فی ارتقاء الجهاز الإداری وتطوره وازدهاره، فالموظف العام یستحق الترقیة والترفیع إلى وظیفة أو درجة أعلى من تلک التی یشغلها إذا ما استوفى الشروط اللازمة لذلک، ولکن قد یصطدم قرار الترفیع بمانع أو أکثر من الموانع التی إذا تحققت ترتب علیها حرمان الموظف من الترقیة أو الترفیع أو تأخیرهما لیس لانتفاء الشروط وإنما لوجود مانع یتعلق بذات الموظف، فکان من الأهمیة بمکان بحث موضوع أثر إجراءات فرض العقوبة الانضباطیة کأحد موانع ترقیة وترفیع الموظف العام لمعرفة الأحکام والآثار التی تترتب علیها فی التشریعین العراقی والأردنی.
