جریمة الاخفاء القسری فی القانون الدولی الجنائی –دراسة حالة العراق

الملخص
بالنظر لکثرة اِنِتهاکِ حُقوقِ الاِنسانِ ولاسیما فی جَریمَةِ الاخفاء القَسْری التی بات ارتکابها بشکل ممنهج ومنظم, بل انها اصبحت جزءاً من السیاسة العامة لکثیر من الدول ضد المعارضین لسیاستها وتوجهاتها، وعلى الرغم من انضمام العراق الى "اتفاقیة حمایة جمیع الاشخاص من الاختفاء القسری" الا انه یعد من الدول المتهمة بارتکاب هذه الجریمة سواء اکان فی عهد النظام السابق ام بعد عام 2003, وهوما دفعنا للبحث عن الیاتِ القَانونِ الدَولِیِ الجِنائِیِ المتعلقة بالحمایة من الاخفاء القَسْریِ التی تتکرس فیـها اَلیَـةً قانونِیةً یُمکِنْ من خلالها القضاء على هذه الجریمة وتحمیل مرتکبیها المســؤولیة الجنائیــة الدولیــة.
