Lawyer’s immunity and their professional Liability
Abstract
lawyers enjoy immunity to be protected from prosecution while defending their clients, and to allows lawyers to do their work freely and independently without the fear of investigation, interrogation or arrest. This immunity is not decided in the personal interest of advocates, rather it is in the public interest represented by the right of defense. Even though, lawyers are not exempt from liability , and if a lawyer commits a disciplinary error, they will be held liable for their mistakes. The disciplinary responsibility of advocates is assumed for professional negligence. This includes if they fail to meet their responsibilities or fulfil their duty of care towards a client deemed to be in breach of their duties.
