Alternative Punishment to Disciplinary Procedures in Public Service

Abstract

This article addresses the idea of how alternative punishments can be adopted judicially instead of the primary punishments. The need for adopting the alternative punishments comes into exist when the primary punishments have failed to achieve its main goals to reform and rehabilitate the convict, as well as other negative effects that accompany its implementation. There exists almost a consensus about the importance of the public employment and its role in improving the life of societies. On this basis, this employment is surrounded by a legal framework, determined in the rights and duties of the public employee. The legislator shall guarantee the establishment of a special penal system for the group of public officials, known as the disciplinary system, in which the penalties imposed on the employee shall be specified if job duties has been breached. Therefore, the disciplinary system as one of the punitive systems is inevitably affected by these modern ideas and trends. Accordingly, the issue of adopting the idea of alternative penalties in it becomes of importance because of similar effects that may contribute to evaluating the employees behavior and reforming the public employment, which prompts us to allocate a specialized study for this subject.
