سحب الید أثر لقرار إحالة الموظف العام إلى القضاء
الملخص
المستخلصإن سحب اليد يعتبر من أهم أثار المخالفة الانضباطية التي يرتكبها الموظف والتي تشكل مساساً بمركزه القانوني وما يمكن اْن يتعرض له من عقوبات انضباطية لاحقة ومن ثم قرار الإحالة إلى القضاء، و الذي قد يؤدي بالنتيجة إلى إنهاء علاقته الوظيفية كأثر على سحب اليد وتجرده من صفته كموظف عام سواء اْكان إنهاء هذه العلاقة والتجريد من هذه الصفة مؤقتا كما في سحب اليد وعقوبة الفصل في قانون انضباط موظفي الدولة(النافذ) اْو نهائياً كما في عقوبة العزل، في القانون نفسه، وإذا كانت الإدارة غير محددة بمبدأ (لا جريمة ولا عقوبة إلا بنص) الوارد في نص( المادة /1 ) من قانون العقوبات رقم (111) لسنة 1969 المعدل: لا عقاب على فعل اْو أمتناع ألا بناء على قانون...) وذلك لأن العقوبات الانضباطية محددة على سبيل الحصر بموجب (المادة/8) من قانون انضباط موظفي الدولة والقطاع العام رقم (14) لسنة 1991 المعدل أما المخالفات الانضباطية ليست محددة حصراً أو نوعا وإنما مردها بوجه عام إلى الإخلال بواجبات الوظيفة العامة اْو الخروج على مقتضياتها، عندها تقوم سلطة الإدارة بتقدير الاْثر المترتب على ارتكاب مخالفة من هذه المخالفات والمتمثل بقرار سحب اليد كأثر لإحالة الموظف العام إلى القضاء، والذي يجوز للإدارة فرضه على الموظف الذي ارتكب مخالفة انضباطية جسيمة.
