Abstract
The provision of judicial protection is the essence of state functions, thus it requires many of the requirements that are required by litigation. These requirements are not necessarily the responsibility of the state, as some of them are the responsibility of the adversaries.The costs of the lawsuit are one of the requirements required by the judicial process and are borne by the litigants in the course of the proceedings before the courts. The costs will be borne by whom lost the lawsuit, which is multiple, Including judicial fees, experience fees, translation, publication, court transfer expenses, lawyers' fees and other expenses.It is right to say that the litigants bear the costs of the case. This is not a violation of the principle of the free charge judiciary, because the principle of the free charge judiciary means that the state pays the salaries of the judges in exchange for their work in the judicial authority, like all other employees, without receiving any fees from the adversaries. The judiciary is a public service because the state bears a lot of burdens that prevent its budget from paying the expenses of the lawsuits. Moreover, the costs of the lawsuit that bears by the state may lead people to resort to the judiciary without reasonable justification or merely to be a grudge and hatred to the other.
