Abstract

The division of the inheritance to the heirs according to the Sunni jurisprudence begins with the one who deserves inheritance, If there remains something inherited by the three types of agnates (a person descended from the same male ancestor) : 1- (The relatives of the dead from male and do not mediate among them female, 2- (Every female with a group of male (who are descended from the same male ancestor), 3- (Each female form a group with the rest of the female), and in the absence of paternal kinsman, the rest of the inheritance is returned to the owner of the Repulse, and the Repulse inheritance can only be achieved if the following conditions are met: 1. The existence of the one who deserves inheritance, because the owners of the Repulse are themselves the one who deserves inheritance according to the different views between scholars. Existence of a surplus of the inheritance after the distribution of the inheritance to the one who deserves the inheritance. That there is no agnate (The relatives of the dead from male and do not mediate among them female, (Every female with a group of male (who are descended from the same male ancestor), (Each female form a group with the rest of the female) in the matter, because if found, the rest of the inheritance inherits by relations on father's side.
