الملخص

أکدت قواعد القانون الدولی الإنسانی فی النزاعات المسلحة الدولیة کافة على ضرورة إنشاء ألیة دولیة تتولى رعایة مصالح أطراف النزاع وحمایة مواطنی أطراف النزاع من المدنیین والعسکریین أثناء فترة النزاع المسلح وهو ما تم تسمیته بنظام الدولة الحامیة لتمکین طرفی النزاع من مواصلة الحوار. والدولة الحامیة هی دولة محایدة او دولة اخرى لیست طرفا فی النزاع یعینها أحد أطراف النزاع، ویقبلها الخصم وتوافق على اداء المهام المسندة إلى الدولة الحامیة التی تتمثل فی حمایة مصالح أطراف النزاع ورعایاها الموجودون فی اقلیم العدو. أن الدولة الحامیة تتمتع بمهام واسعة النطاق فی مجال تنفیذ احکام القانون الدولی الانسانی بموجب اتفاقیات جنیف الاربعة لعام 1949 وبرتوکولها الاضافی الاول الملحق بها لعام 1977، حیث تکلف الدولة الحامیة برعایة مصالح أطراف النزاع خاصة مصالح أسرى الحرب والمدنیین، ولذلک تساهم الدولة الحامیة فی التطبیق المباشر لقواعد القانون الدولی الانسانی وتشرف على مدى التزام أطراف النزاع بتطبیق قواعد القانون الدولی الانسانی.
