Abstract

This research deals with the subject of the partial objectives of stipulating the dowry in the marriage contract in the book Fath al-Qadeer, where the focus is on the partial objective on which Imam Ibn al-Hammam built the jurisprudential branches in his book Fath al-Qadeer, and then mentioned the sayings of scholars that support what Ibn al-Hammam argued Then, the partial purpose of the dowry in the marriage contract is to demonstrate the honor of the contract and demonstrate its danger. This is because of the effects, rights and duties it entails, and the dowry is one of the wifes rights, and the purpose of offering the dowry to her is; Out of pride, honor and appreciation for her, and a declaration of his desire to seek marriage with her, and to bring pleasure to her, and by it the law guarantees that the contract will not be negligent and respected. In addition to that, it is desirable to make the dowries easy and to make its expenses easy, and not to go to extremes in it, because by it marriage is achieved, and by it the immunity of young men and women prevails, and by it Weaken evil and corrupt impulses, thus ensuring the individuals well-being and society.
