The partial purpose of not cutting off a guest’s hand if he steals from someone he hosted and does not take what he stole out of the house according to Al-Kamal Ibn Al-Hammam.
Abstract
This research deals with the partial purpose of not cutting off the hand of a guest if he steals from the one who hosted him and does not take what he stole outside the house according to Al-Kamal Ibn Al-Humam. I followed the inductive and analytical approach, and divided the research into an introduction, two chapters, and a conclusion. The first chapter defines the terms of the title, and includes four demands. The first demand: Definition of the objectives of the Sharia. The second demand: Definition of the partial objectives. The third demand: Definition of theft. The fourth demand: Definition of Al-Kamal Ibn Al-Humam. The second section included: The partial purpose of not cutting off the hand of a guest if he steals from the one who hosted him and does not take what he stole outside the house according to Al-Kamal Ibn Al-Hammam. The issue was studied and arranged in four stages, which are: Documenting Ibn Al-Hammams words, then the evidence, then studying the issue, and finally a brief conclusion to the issue. Then after that, I ended the research with a conclusion that includes the most important results that I reached, then I mentioned the most important sources and references that I relied on in this research.
