Grammatical presence in the jurisprudential lesson in Al Tahtawi’s footnote on Maraqi Al-Falah - the chapter on attachment as an example -
Abstract
The research dealt with the concept of grammatical attachment, especially the attachment of the preposition and the genitive and the circumstance to other grammatical components, and its effect on the interpretation of jurisprudential texts. The research relied on studying and analyzing the statements of scholars, such as Al-Tahtawi and Al-Sharnbalali, who pointed out the importance of accurately identifying the positions of attachment to understand the legal rulings correctly. The most prominent points that the research addressed were:The role of attachment in explaining the reason and purpose of the legal rulings, such as the requirement of intention and the effect of different attachments in determining the validity of worship. Analyzing conditional and nominal sentences and linking them to the jurisprudential context, such as the effect of attachment on determining the conditions for the validity of prayer, fasting and vows. Distinguishing between conjectural and definitive rulings through grammatical guidance, and the effect of that in achieving correct inference in Islamic jurisprudence. Reviewing examples of jurisprudential texts that illustrate how grammatical attachments affect the derivation of the legal ruling.The research concluded that grammatical attachment is not just a linguistic issue, but rather an essential tool for understanding legal texts and controlling jurisprudential rulings according to a precise methodology.
