الملخص
المستخلص أن هذا البحث هو محاولة لتسلیط الضوء على السیاسة الجنائیة العقابیة التی انتهجها المشرع العراقی فی قانون المخدرات والمؤثرات العقلیة رقم 50 لسنة 2017 ، لاسیما فی ظل انتشار ظاهرة الاتجار والتعامل غیر المشروعین بالمواد المخدرة والمؤثرات العقلیة واتساع دائرة تعاطیها والادمان علیها ، بحیث اصبحت هذه الظاهرة حدیث الشارع العراقی ، لما لها من اثار سلبیة خطیرة تهدد المجتمع ککل على کافة مستویاته الاجتماعیة والاقتصادیة والصحیة ، وبیان مدى مواکبة هذه السیاسة للسیاسة العقابیة المعاصرة ، فضلا عن مدى کفایتها فی مکافحة ظاهرة التعامل غیر المشروع بالمواد المخدرة والمؤثرات العقلیة فی صوره کافة أو الحد منها على أقل تقدیر .
