Abstract

To enable the creditor to obtain his right. The judicial ruling must be implemented in the execution department. So the debtor implements what the judgment required and appeals the judgment to the competent court, which annuls that decision either by nullity, annulment or cassation. The situation must be restored to the way it was. The creditor becomes the debtor, and the debtor becomes the creditors position, and he demands the return of what he previously handed over. This is what the author discussed in his book Reverse Enforcement in Civil Judicial Judgments - A Comparative Study.
