The constitutional and international guarantees for the human right to housing: A case study of Iraq
Abstract
The right to housing is one of the fundamental human rights that is interconnected to other human rights which cannot be abandoned. It can be argued that any violation of this right will lead to the violation for other human rights as they are strongly interlinked. Therefore the right is a universal right applicable to all human beings and protected in international law and national constitutions, including the constitutional legislator beside the international charters and the declarations of human rights that directly or implicitly emphasized on this right, in addition to the concern of international humanitarian law that under the circumstances of the war provided for adequate housing, especially for marginalized groups such as children, women, and the elderly, who are unable to protect their rights, however, despite the provisions , it is repeated over on the human right to housing However, it violates most of the time, leading to an increase in slums and poor neighborhoods, which are densely populated and that live under conditions and an environment that is not suitable for housing and lacks the most basic necessities of life due to the lack of housing units compared to the increase in population. In addition to the absence of house building projects in the country also the absence of censorship in the random areas. Therefore, the countries including Iraq are obliged to implement its obligation under international law and provide the appropriate housing for people to ensure the prosperity for society.
