میناء مبارک وأثره فی حق العراق بالملاحة البحریة

الملخص
شغلت مشاکل تخطیط الحدود بین العراق والکویت حیزاً کبیراً من التاریخ المشترک للدولتین، وابتدأت هذه المشاکل مع سنة 1931، وبدء محاولات الکویت بالانسلاخ عن الوطن الأم، وأکثر هذه المشاکل کانت تتعلق بالحدود البحریة، التی لم تستطع حتى لجنة تخطیط الحدود التی شکلتها الأمم المتحدة فی سنة 1991 من إیجاد حل لها، ویشکل تشیید میناء مبارک فی منطقة حدود بحریة غامضة وغیر متفق علیها تجدیداً لهذه المشاکل التی تفتعلها الکویت، وتهدیداً لحقوق العراق الملاحیة ومصالحه الاقتصادیة، ومخالفة لقواعد القانون الدولی العام التی تضمن الحقوق الملاحیة للدول المتشاطئة
