التنظیم القانونی لقواعد المسؤولیة المدنیة لمراکز نقل الدم دراسة تحلیلیة مقارنة

الملخص
ان اهمیة عملیة نقل الدم وخطورتها تستوجب توافر شروط قانونیة وفنیة، لابد من مراعاتها فی کل من المتبرع والمتبرع له، والتی تعد شروطا مهمة ومخالفتها تمثل مخالفة لما اقرته القوانین ومحققة للمسؤولیة المدنیة، فقد ترتکب مراکز نقل الدم أخطاء، وهذه الاخطاء قد تصیب أحد اطراف عملیة نقل الدم من متبرع، أو متبرع له، أو الغیر، بأمراض واضرار صحیة قد تصل الى حد الوفاة، وبذلک تنهض وتتحقق المسؤولیة المدنیة، الا ان احکام المسؤولیة المدنیة طبقا للقواعد العامة قد لا تکون کافیة بالنسبة لمسؤولیة مراکز نقل الدم، لما تتمتع به تلک المسؤولیة من خصوصیة، الامر الذی یتطلب ایجاد قواعد خاصة تحکم الموضوع، وخصوصا ان المشرع العراقی لم یعالج عملیة نقل الدم بنصوص قانونیة محکمة.
