The pillars and conditions of the waqf   Comparative Study in Islamic Jurisprudence and Arab Laws

Abstract

The issue of waqf is one of the important issues as a legal system from creating Islamic jurisprudence in order to preserve the unity of society and uphold its land. The jurists concerning the waqf system in the most issues and its ramifications and its particles have aroused a wide scientific debate, which is truly a great wealth worthy of pride and study. Waqf is to prevent the disposition of the property, and charity to the faces of righteousness and goodness, the Messenger of Allah (peace be upon him) said, "When a man dies, his deeds come to an end except for three things: Sadaqah Jariyah (ceaseless charity); a knowledge which is beneficial, or a virtuous descendant who prays for him ", and Tirmidhi said that it is a correct and good hadith. So, the scholars interpreted the ongoing charity as (waqf).
