A jurisprudential study of the Electronic Pimping crime based on Judicial precedents
Abstract
There is no doubt that scientific advancement and the increasing sophistication of cyberspace have impacted concepts of criminal justice, including crime and punishment. The use of new technologies by criminals has led to a new generation of crimes that can be called crimes with a developed structure. Electronic pimping is the design of a software system that uses artificial intelligence to bring individuals together for adultery and sodomy; It is a type of crime with a developed structure. The application of the Hudud punishment to the developed form of pimping crime requires a study of jurisprudential references, where the bringing together term was mentioned in the narration of the jurists, which shows that the use of the term in circumstances in which cyberspace has become an integral part of human life. It moved away from the abundance of existence in real space and evolved in its metaphorical sense. It had not been easy to claim that the frequent use of this word among the public was consistent with its true meaning. Therefore, in addition to jurisprudence that expressly shows acceptance of the developed form of pimping and acknowledges attributing the work of the program or application to its designer, the Had of pimping can be imposed on the electronic form of it.
