رخصة الزواج بین الضرورة والشرعیة

الملخص
يُعد موضوع البحث من الموضوعات المستجدة ذات الأهمية الكبيرة لأنه يتعلق بالرابطة الزوجية التي تَجمع شمل الأُسرة، بعد أن أصبح الطلاق ظاهرةً تُهدد الكثير من الأسر المسلمة فاقتضت المصلحة العامة وضع التدابير الشرعية لعلاج تلك الظاهرة السلبية فظهرت رخصة الزواج وسيلة علاج للتقليل من حالات الطلاق من طريق تشريعها شرطاً قانونياً لإبرام عقد الزواج وموضوعها الأساس تهيئة المقبلين على الزواج للحياة الزوجية من طريق إخضاعهم لدورة تدريبية تتضمن موضوعات شرعية واجتماعية ونفسية تعمل على تثقيفهم بطبيعة الحياة الزوجية؛ فلا يتم إبرام عقد الزواج قبل الحُصول على شهادة دورة رخصة الزواج إجازة تُثبت استعداد العاقدين للدخول في الحياة الزوجية فكان لها أثراً واضحاً في التقليل من حالات الطلاق في الدول التي شرعتها، وحاجة المجتمع العراقي لهذه الرخصة أصبحت أمراً ضرورياً بعد الزيادة في معدلات إيقاع الطلاق.
