Subjectivity of fraud in civil procedure
Abstract
Procedural fraud is one of the most important means that a litigant may use to divert the course of a case or lawsuit in his favor. It constitutes a form of manipulation of judicial procedures, aimed at obtaining a right not granted by law through fair means. Procedural fraud is considered one of the most serious forms of corruption affecting the judicial process. There is no Arab or foreign legislation that does not emphasize the importance of providing safeguards to prevent such fraud. Legal studies addressing procedural fraud have focused on defining this practice, which seeks to unjustly alter the course of litigation in favor of one party. These studies also provide detailed explanations of procedural fraud, recognizing its serious threat to the integrity of judicial proceedings and the discovery of truth in civil and other cases.
