Abstract

Abstract The criminal moratorium criminalizes every behavior that results in setting fire to movable or immovable property even if it is owned by the torchbearer, whenever that would endanger the life of people or their property. According to the principle of criminal legality, we note that the Iraqi penal legislator mentioned a criminal text according to it. Every behavior that involves setting fire to movable or immovable property, and from this standpoint it can be said that fire accidents necessitate criminal responsibility, whether these accidents result from criminal behavior preceded by a free and select will, or from criminal behavior preceded by a violation of the duties of prudence and caution.
