The provisions of the marriage of Hermaphrodite in Islamic jurisprudence and positive law

Abstract

Marriage is highly valued in Islam and one of its most important pillars of the marriage contract in Islamic law that parties involved must be of different sex or gender . Thus with this difference in gender, the roles are complemented and the desired purposes of marriage are fulfilled. That this difference is attained by the clear and unfulfilled hermaphrodite in the problematic hermaphrodite, and this is why the clear hermaphrodite marriage is permissible according to the Muslim jurists. Marriage and the fate of marriage, but that the hermaphrodite is clear of his gender to the other type, the jurisprudence prohibits marriage and his marriage is nullified if he is married for legal and natural reasons.
